Croydon, N. Y.-based drug maker Pfizer Inc. said Tuesday it will pay $1 billion to settle a lawsuit it filed against the Food and Drug Administration to force companies to stop selling prescription-only impotence drugs that contain sildenafil.
The settlement resolves claims of erectile dysfunction drug Viagra that had been used by millions of men in the U. S. since 1998.
The lawsuit, filed in federal court in New Jersey, accused Pfizer of marketing sildenafil-containing drugs as a "pharmaceutical" product. But the drug maker said the settlement was not intended to resolve claims that Pfizer improperly marketed sildenafil as a "pharmaceutical" drug.
"Pfizer, along with its subsidiaries and some other companies, manufacture and distribute prescription and over-the-counter (OTC) pharmaceuticals, including Viagra," said the complaint.
The lawsuit alleges that Pfizer, the maker of Viagra, manufactured and distributed sildenafil-containing drugs in violation of federal law.
The lawsuit is not set in stone and is pending in the U. District Court in New York. The drug maker said it was aware of the lawsuit, but did not release details.
The lawsuit, filed Wednesday in the New York Federal District Court, alleged Pfizer knew about the lawsuit, but that it did not release details about the lawsuit until after it was filed in April 2010.
The suit, filed in U. District Court in Manhattan and unsealed in February, alleges the drug maker did not properly disclose the lawsuit until after it was filed in September 2010.
Pfizer spokeswoman Mary Ann Evans said the company did not have a "close relation" with the plaintiff until late March 2010.
"Pfizer, along with its subsidiaries and some other companies, manufacture and distribute prescription and OTC pharmaceuticals, including Viagra," Evans said in a statement.
Her statement is the result of Pfizer's investigation into the company and the lawsuit. Pfizer is seeking unspecified damages.
